By accessing or using PageGuard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PageGuard is a website health scanning tool that analyzes publicly accessible web pages for performance, accessibility, SEO, and best practices. Results are generated using Google PageSpeed Insights and AI-powered analysis.

3. Acceptable Use

You agree to:

Only scan websites you own or have authorization to scan
Not use the Service to harass, attack, or disrupt other websites
Not attempt to circumvent rate limits or abuse the API
Not use automated tools to scrape or bulk-access the Service beyond the provided API
Comply with all applicable laws and regulations

4. Accounts and API Keys

You are responsible for maintaining the confidentiality of your API key. You are responsible for all activity that occurs under your key. Notify us immediately if you suspect unauthorized use.

5. Paid Plans

Paid subscriptions are billed monthly through our payment provider, Creem. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis — contact support@pageguard.org.

6. Intellectual Property

The Service, including its design, code, and branding, is owned by PageGuard. Scan reports generated for your websites are yours to use, share, and export.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

Scan results are 100% accurate or complete
The Service will be uninterrupted or error-free
Following scan recommendations will ensure legal compliance (including ADA/WCAG compliance)

PageGuard is not a substitute for professional legal or accessibility advice. Scan results are informational only and do not constitute legal guidance.

8. Limitation of Liability

To the maximum extent permitted by law, PageGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these terms or for any other reason, with or without notice.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
